Service Terms Radial Torque Tools B.V.
1. Registration obligation via OutSmart
a. Service requests must preferably be submitted through the OutSmart system.
b. Requests registered via OutSmart will receive priority in scheduling.
c. If no registration has been made through OutSmart, Radial Torque Tools B.V. cannot make any commitment regarding scheduling or the availability of required parts and resources.
d. By submitting a torque wrench to the service center, regardless of the method of delivery or registration, the client unconditionally agrees to these service terms and conditions.
2. Quotations and response times
a. Any quotation issued by Radial Torque Tools B.V. is valid for a maximum of fourteen (14) calendar days from the date of issue.
b. If no written confirmation/purchase order from the client is received within this period, the quotation automatically expires, and the reserved parts will be made available to other customers.
c. If no response from the client is received within eight (8) weeks after the quotation has been sent, the torque wrench will be returned in its non-working condition, and possibly disassembled, condition. Inspection and shipping costs will be charged to the client.
d. A quotation is merely a non-binding cost estimate. The final costs may differ from the quotation provided. Radial Torque Tools B.V. will inform the client as soon as possible of any substantial deviations.
e. Quoted lead times are indicative only and depend, among other things, on parts availability, service center workload, and external factors.
f. If, during inspection, it appears that total repair costs will not exceed eight hundred euros (€800) excluding VAT, Radial Torque Tools B.V. is entitled to carry out the repair without prior client approval. In such cases, the client will be informed after completion of the work and requested to provide a purchase order number.
g. All shipping, import, and any insurance costs for sending and returning tools are at all times for account of the client, unless otherwise agreed in writing.
3. Warranty terms and liability
a. Repaired torque wrenches are covered by a warranty of three (3) months after repair. Within this period, defective parts will be replaced free of charge, and the torque wrench will be restored to working condition, including a calibration certificate, provided that the torque wrench and the reaction arm(s) used are returned at the client’s expense.
b. If the reaction arm is missing upon return, no warranty claim can be processed.
c. Clients and distributors who open or modify torque wrenches without having first completed training organized by Radial Torque Tools B.V. in Soest irrevocably forfeit their right to warranty.
d. Radial Torque Tools B.V. is not liable for defects, damage, or consequential damage resulting from unauthorized alterations, modifications, or repairs by third parties.
e. Warranty is only granted for defects arising from normal use and in accordance with the instructions provided by Radial Torque Tools B.V.
4. Returns and storage
a. If the client declines to proceed with the required repair work, the torque wrench will be returned in its non-working condition, and possibly disassembled, condition.
b. Radial Torque Tools B.V. is not obliged to restore the torque wrench to its original condition if the repair is declined.
c. If the client fails to collect or arrange delivery of the torque wrench within four (4) weeks after notification of completion, Radial Torque Tools B.V. is entitled to charge storage costs of €15 per working day.
d. If the client has not collected the torque wrench within six (6) months after notification of completion, and remains in default after an additional written reminder with a thirty (30)-day period, Radial Torque Tools B.V. is entitled to sell the product or, if sale is not reasonably possible or profitable, to have it destroyed. Any proceeds from the sale, after deduction of reasonable costs for storage, administration, and sale, will be paid to the client. The client cannot claim any further compensation in this case.
5. Deviations
a. Radial Torque Tools B.V. reserves the right, in exceptional cases, to deviate from these terms in writing without affecting the validity of the other provisions.
6. Applicability of General Terms and Conditions
a. All service orders are also subject to the General Terms and Conditions of Radial Torque Tools B.V.
b. In case of any conflict between these service terms and the General Terms and Conditions, the provisions of these service terms shall prevail.
7. Invoicing and payment conditions
a. If a purchase order number is generally required for invoice processing, the client is requested to provide it within ten (10) working days after the request. If the purchase order number has not been received within this period, the invoice will be issued to the client without a purchase order number.
b. All invoices must be paid within the agreed payment term as stated on the invoice, unless otherwise agreed in writing.
